Effective starting: June 01, 2019

This is an agreement between Job Applicant/Employer or any other authorized representative (hereinafter "You" or "Your") and Softink Lab (hereinafter referred as “Jobs Daily”) for the purpose of access, participate and post the resume. By using the services of the website, it shall be deemed that you have acknowledged and have given your consent to be bound by this Agreement and also with the Privacy Policy and the same is incorporated and made part of this Agreement. In addition, while using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. IF YOU DO NOT UNDERSTAND THIS AGREEMENT, OR DO NOT AGREE TO BE BOUND BY IT OR THE PRIVACY POLICY, YOU MUST IMMEDIATELY LEAVE THE WEBSITE AND CEASE USING THE SERVICES OF THIS WEBSITE.

Jobs Daily site and its components are offered for informational purposes only; this site shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site and shall not be responsible or liable for any error or omissions in that information.

The following are the Terms and Conditions of the website and are subject to acceptance and adherence by you thereof.

EMPLOYEE (Job Applicant)

Registration Process

Any person who is looking for a suitable job can register with our website for free of charge.

Once, the user is registered and has uploaded his/her resume on Jobs Daily for the desired job, the employers who are registered with us shall contact the applicant if the resume is matching with their job profile.

During any time, the user can modify or change or update the information and resumes uploaded on Jobs Daily without any prior consent of the website.

NOTE: APPLICANT RESUME AND INFORMATION SHARED WITH JOBS DAILY SHALL BE VISIBLE TO ALL THE EMPLOYERS REGISTERED WITH US. (Please refer Privacy Policy for more information)

Job Apply

Job Applicant can apply for any job listed in the Jobs Daily. Employee should provide correct and reliable information in his/her curriculum vitiate, uploaded cv’s and other related documents. Employee should not use Jobs Daily platform to mislead employers in any action. If we find any information is faked / fabricated, not accurate, offensive, harmful or intend to damage directly or indirectly, under Acceptable Use Policy we can terminate your Jobs Daily Account.

Retain of The Information

The information shared in the form of resume by the user voluntarily to the website shall be retained and stored by the website indefinitely.

Confidentiality

The information provided to the website is safe and confidential. They shall not be used by us in any way for making any monetary transactions. In the due course of law, if any of the government machinery or under any law which is applicable in Democratic Socialist Republic of Sri Lanka, we are obliged to share the information of the user to that authority asking for the information.

Relationship

The relationship between the Job Applicant and Jobs Daily is that of fiduciary relation. In no manner, it shall not be deemed to be offer being provided by Jobs Daily and acceptance by the Applicant. Therefore, it does not give rise to any kind of Contract under Sri Lankan laws.

Liability

It is the responsibility of each of the users with Jobs Daily to provide with the reliable information which are not fake and does not land the user behind the bar. So, it is the sole responsibility of the user to be true with the information being provided to Jobs Daily. It is also the responsibility of the applicant to know the legitimacy of the employer / job before him/her applying for desired vacancy. Jobs Daily shall not be liable if the applicant is lured by any of the employer registered with Jobs Daily. It is also the responsibility of the user to use the website with due diligence and with utmost good faith.

Alerts

The registered users with Jobs Daily shall receive frequent email alerts to the email id registered with in case of any vacancy in the desired job and also to which the user has applied for. In case, the registered user has provided with the mobile number at the time of registration with our website, we shall also send message if the user wants Jobs Daily to notify them through text messages.

Communication

Employer can communicate with Job Applicant directly and Jobs Daily will not be liable to any correspondences whatsoever.

No Guarantee

Jobs Daily is neither providing any kind of placement in any company nor providing any sort of consultation in respect of any job posted on Jobs Daily. Therefore, Jobs Daily gives no guarantee for the Job Applicant for the desired vacancy applied for.

Prohibited Content

Users may not post links or email that contains, promotes, gives instruction about, or provides prohibited Content which may include any Content that infringes any Local, State, County, National or International law. For any other purpose which is not expressly permitted in this Agreement shall be deemed prohibited and therefore shall be liable for the consequences thereof if any. Please refer Acceptable Use Policy for more information.

EMPLOYER

Registration Process

The desired employer can register with Jobs Daily for free of charge. It is mandatory for any employer to provide with the contact details of the representative of the company in order to ensure authenticity of the person. Once the employers get registered with the website, the same shall be verified and approved by Jobs Daily.

Once the registration is approved by Jobs Daily, the employer can post the advertisements, use the system functions and pick up the required resumes for their job profile. If we find any information is faked / fabricated, not accurate, offensive, harmful or intend to damage directly or indirectly, we shall not proceed to publish and cease the service.

NOTE: Employers publishing job offers on Jobs Daily, accept that same will be visible to any registered or unregistered visitors.

Job Advertisement Publishing

Employer should include correct information in advertisements. By placing an order in Jobs Daily you are agreed to follow Payment Policy, Acceptable Use Policy and Terms of Service of Jobs Daily. If we find any information is faked / fabricated, not accurate, offensive, harmful or intend to damage directly or indirectly, we will unpublish your ad with or without informing to you. Under Acceptable Use Policy these cases may lead to a complete termination of your Jobs Daily Account.

Any advertisement that are considered as offensive, harmful or cause any damage whatsoever are prohibited by any Local Law, National Law and International Law.

Payments

Jobs Daily accept several payment methods including Bank Transfers and Online Payments. Please refer billing policy for more information.

We do not store your credit card information or any other sensitive information related to billing. All the billings are handled by our service providers and all transactions will be processed on their platforms.

Liability

By posting, publishing or uploading any type of job offer on Jobs Daily, employer confirms that they are in possession of the required permission, licenses for recruitment. The employer shall indemnify Jobs Daily in case of any action or claim against Jobs Daily because of lack of this requirement or any action or claim arising out of this requirement against Jobs Daily. The employer accepts that once information and data is provided, the same will be published in Jobs Daily with all the rights and obligations that the same entitles. It is of employer's duty and liability to check and verify all the information given by the Job Applicant. The users of Jobs Daily cannot claim any type of Intellectual Property Rights or Copyrights by the information and data uploaded and published on Jobs Daily. It is of user's liability and responsibility not to publish any false information under Jobs Daily. This will lead to an immediate cease of services.

Relationship

The users accept that Jobs Daily at its sole discretion can modify, update, change, suspend, withdraw, and add any service or content in its entirety or part of the same. Jobs Daily shall give 02 months prior notice to it’s registered Employers if Jobs Daily terminates it’s services, the registered employers will be compensated accordingly if any ongoing contracts are in progress.

Limitation of Liability

Jobs Daily shall not be held liable for any harm, losses and damages directly or indirectly caused by the use of Jobs Daily. Jobs Daily liability is only to the extend and limits to the technical problems due to which the proper use of Jobs Daily is hindered.

Jobs Daily shall not be held liable for the reality and accuracy of the data and information given by either by the Job Seeker or by the Employer. Jobs Daily is not responsible of the authentication of the content published on Jobs Daily.

Jobs Daily shall not be liable for any loss of data due to force majeure or any circumstances out of our control.

Jobs Daily shall not be liable for complaints, claims or actions initiated by third parties due to users misconduct, omission or action related to Jobs Daily when uploading and transmitting data through Jobs Daily.

Intellectual Property

The Site and its original content, features and functionality are owned by Jobs Daily and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Applicable Law

These Terms and Conditions are subject to the laws applicable in Democratic Socialist Republic of Sri Lanka and are governed accordingly.

Unless otherwise indicated, all the contents on Jobs Daily are copyrighted by Softink Lab.

No part of this website shall be used for any other purpose than mentioned. Therefore, reproduction, modification, storage in a retrieval system or retransmission, in any form or by any means, electronic, mechanical or otherwise, for any reason, is strictly prohibited without prior written permission.

Dispute Resolution

Any dispute which may arise in the future with respect to interpretation of any terms and conditions, any dispute arising between the any parties shall be subject to Sole Arbitrator under the Arbitration and Conciliation Act no. 11 of 1995. The language to use is English and the expenses shall be shared equally among the parties.

Third Party Services

Third party means one which is not associated or connected with Jobs Daily. Any redirect to other website through the discussion platform or any advertisement on the website and henceforth Jobs Daily shall not be held liable for any such decryption. Disclaimer

UNDER ANY CIRCUMSTANCES Jobs Daily WILL NOT BE HELD LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES/LOSSES FOR ANY USE OF THE SITE, OR LINKS TO THIRD PARTY SITES INCLUDING ANY LOST PROFITS, BUSINESS LOSSES, DATA LOSSES, OR ANY PROPERTY LOSSES.
